Terms of use for the nTilia service

These terms govern access to and use of nTilia, the Markdown editor and journal provided by SamionX. By creating an account or using the service, you accept these terms.

1. Definitions and scope

These terms apply to the nTilia SaaS Service. Custom SamionX engagements (development, consulting) may be subject to separate specific terms.

2. Service description

  • Markdown editing, local drafts and cloud sync
  • Browser dictation (offline) and AI-assisted editing via Anthropic (depending on plan)
  • Public journal and profile pages, depending on settings
  • Free / Pro / Pro+ subscriptions and related AI credits

SamionX may evolve the Service (features, UI, limits). Material changes will be communicated where reasonably possible.

3. Account and access

  • You must provide accurate information and keep your credentials confidential
  • You are responsible for activity carried out through your account
  • Your email address must be confirmed to use AI credits and to publish an article publicly
  • The Free plan is subject to quotas (cloud articles and public posts per month) shown in the offer
  • SamionX may suspend an account in case of abusive, fraudulent or unlawful use

4. Pricing, payments and cancellation

  • Prices are shown in euros incl. tax; applicable VAT (Belgium, EU reverse charge or exemption) appears on the Stripe invoice
  • Subscriptions are billed via Stripe on the chosen cycle (monthly / yearly); a PDF invoice is issued at each renewal
  • A business VAT number may be entered at checkout; it appears on the invoice for accounting deduction, subject to validity
  • You may cancel at any time; paid access remains until the end of the period already paid, unless otherwise stated
  • Unused AI credits may be subject to rules shown in the app

In case of non-payment or fraud, SamionX may immediately suspend access to paid features.

5. User content

You retain ownership of your Content. You grant SamionX a limited, non-exclusive, worldwide licence to host, sync, display and process that Content solely to provide the Service (including AI features you trigger).

  • You warrant that you hold the rights needed for published Content
  • Prohibited: unlawful, defamatory content, infringement of third-party rights, malware, spam
  • Public Content is visible according to your settings; you remain responsible for what you expose

6. Public journal and AWAKEN DESTINY link

nTilia lives in support of AWAKEN DESTINY (https://awakendestiny.org), a Belgian private foundation. David Herreman, director of SamionX, is also its founder and president. The link aims to raise awareness of the foundation.

  • On the Free plan, the public journal footer displays by default “Powered by nTilia, a SamionX product. nTilia supports the AWAKEN DESTINY foundation.”, with a link to the foundation’s website
  • The Free-plan public journal remains shareable by URL; it is not submitted for search-engine indexing (noindex, excluded from the sitemap, no JSON-LD)
  • Indexing (sitemap, JSON-LD, robots index) is a Pro and Pro+ benefit
  • Hyperlinks in your Content (article body, website or donation link) are, on all plans, marked for search engines as user-generated (rel “ugc” and “nofollow”); they remain clickable. Pro indexing applies to your journal pages, not to passing SEO authority to third-party sites
  • From Pro and Pro+ plans, you can hide this link in journal settings
  • This credit is not commercial advertising for an unrelated advertiser; it is part of nTilia’s freemium model
  • nTilia marketing pages (home, pricing, etc.) may also show this link; that is SamionX as publisher, not your Content

By using the public journal on the Free plan, you accept display of this link until it is hidden via a plan that allows it.

7. Artificial intelligence features and the AI Act

nTilia includes AI-based writing assistance. GPAI models are provided by Anthropic, PBC (Claude), via the Claude API. SamionX provides the assistance system integrated in the Service. Outputs are provided as help; they may contain errors, approximations or bias.

  • You must verify any AI output before publication, sharing or an important decision
  • The interface states, from first use, that assistance is AI-based (Art. 50(1))
  • Generative outputs carry a machine-readable technical mark; standard editing (proofreading, translation) is exempt (Art. 50(2))
  • Use of AI features consumes credits / quotas according to the plan
  • The Free plan includes editing AI (proofreading, structure); generative writing (continue, SEO, article translation, etc.) is reserved for paid plans
  • You agree to comply with Anthropic’s Acceptable Use Policy and not to misuse AI for purposes prohibited by the AI Act or that policy
  • If you publish AI-generated or heavily AI-assisted text to inform the public on a matter of public interest, you are responsible for ensuring, where applicable, labelling and/or substantive human editorial review (Art. 50(4)). nTilia reminds you of this when you publish
  • SamionX is not liable for decisions taken solely on the basis of an AI output

8. Service intellectual property

nTilia, its brand, code, design and documentation remain the property of SamionX or its licensors. No transfer of rights is granted beyond authorised personal or professional use of the Service.

9. Availability, warranties and liability

The Service is provided “as is”. SamionX endeavours to provide reasonable availability but does not guarantee uninterrupted service.

  • Limitation: to the extent permitted by law, SamionX’s liability is limited to amounts actually paid by the User over the preceding 12 months
  • Exclusion: indirect damages, loss of business, data loss not attributable to gross negligence by SamionX
  • Nothing in these terms excludes liability for fraud or wilful misconduct

10. Confidentiality and personal data

Personal data processing is described in the Privacy Policy. DPO contact: dpo@samionx.com.

11. Force majeure

Neither party is liable for failure due to a force majeure event (disaster, widespread infrastructure outage, government decision, large-scale cyberattack, etc.).

12. Governing law and disputes

Belgian law. Courts of Charleroi (Belgium) have jurisdiction, after an attempt at amicable resolution (negotiation then mediation if needed).

13. Changes

SamionX may amend these terms. The version in force is the one published on the site. For subscribers, reasonable notice will be sought for material changes; continued use after the effective date constitutes acceptance, unless you cancel.
